Planning is key - Don’t delay an LPA

A solicitor has warned that many are ‘leaving it too late’ to put Lasting Powers of Attorney (LPA) in place.

Nicola Dalzell, of Tilly Bailey & Irvine Solicitors who specialises in Wills, Probate and Trusts, stressed the importance of acting whilst a person is still considered able to make decisions about their future. She spoke out following a number of news stories relating to dementia care in the UK.

Nicola said: “Planning is key. We can’t stress how important it is to make a Lasting Power of Attorney earlier rather than later. Any adult who wishes to ensure their wishes are met, should they no longer be able to decide about their own care, wellbeing and finances, should act now to make an LPA.

“It is especially important that anyone diagnosed as being in the early stages of alzheimers prioritises an LPA, before there is any further deterioration of their health. Only then can they be confident that their wishes will be acted upon, and that those who they choose will look their affairs.”

She commented that a number of care homes now recommend that residents prepare an LPA when they move in so that staff are clear what the person’s wishes are.

In response to moves by some banks to train staff to deal with customers with dementia, Nicola advised caution. She added: “Anyone who is dealing with a customer who they believe might be suffering from dementia should be extremely careful. If in any doubt, seek further advice from someone experienced in working with and advising those with dementia.”
